Disciplinary and Grievance Procedures

As of 6th April 2009 Statutory dispute resolution procedures have been repealed for actions arising often that date but complex traditional arrangements apply to case where potential causes of action are prior to 6th April 2009.

Every employer should review their disciplinary and grievance procedures so that they are compatible with the current law.

What is a grievance?
Put simply a grievance is any work related problem which employee wants to address if possible resolved.

What is the statutory disciplinary procedure?
This is a three step process and similar three step process is applicable to statutory grievance procedure.
The three steps are as follows.
  • Step one: A statement in writing of what the employee/employer have alleged to have done.
  • Step two: A meeting to discuss the situation.
  • Step three: Hold an appeal if requested by the employee.
